CPSC Recall Snapshot: Should Repair Programs Be Called Recalls?

Welcome to the August edition of the Alston & Bird CPSC Recall Snapshot.

This past month, the CPSC announced the offering of free repair kits for children’s and adult chests and dressers. Interestingly, the CPSC did not label the issuance of these repair kits as a product recall, despite their previous practice of doing so in a similar situation involving furniture. The press, for their part, appear to be still calling this a recall. Whether the CPSC will continue to avoid labeling such situations as a recall is not yet clear, but such a practice would be beneficial for client relations and for clarity’s sake.
