CPSC Recall Snapshot: The New Norm in Civil Penalties and Fidget Spinners in the Crosshairs

Welcome to the June edition of the Alston & Bird CPSC Recall Snapshot.

Earlier this month, the CPSC announced a $5.2 million civil penalty against a recreational vehicle manufacturer for alleged “failure to report defective ROVs and misrepresentation.” This is the third civil penalty announced in 2017, and the amount is almost exactly in the middle of the $4.65 million civil penalty announced in April and the $5.8 million civil penalty announced in February. It’s unclear if these penalty amounts reflect the new norm for the CPSC and the end of the penalties in the $1 – $2 million range we saw just a few years back.
