The Law of 23 July 2016 regarding the organisation of the criminal record was published in yesterday’s Mémorial. Its entry into force is set for 1 February 2017.
One of the essential points of the Law is the creation of several reports with a breakdown of the entries depending on the aim for which the report is delivered.
The Law in 5 points:

The employer may ask the candidate to provide a criminal record provided that the request is submitted in writing (eg.: in the job offer or by e-mail during the recruitment process) and that it is specifically justified in relation to the specific requirements of the job position;

The shortening of the period for which the report may be stored from twenty-four months to one month as from the conclusion of the employment contract;

The destruction of the report if the person concerned is not hired;

The possibility for the employer to request the issuance of a new report when it is required by specific provisions (for example: in terms of security or financial undertaking) or in case a new assignment requires a new check;
-
Criminal sanctions in case of non-compliance with the new provisions.
La loi du 23 juillet 2016 relative à l’organisation du casier judiciaire a été publiée dans le Mémorial d’hier. Son entrée en vigueur est fixée au 1er février 2017.
Un des points-phares de la Loi est la création de plusieurs bulletins avec une ventilation des inscriptions en fonction de la finalité pour laquelle le bulletin est délivré.
La Loi en 5 points :

L’employeur pourra demander au candidat de lui remettre un extrait de casier judiciaire à condition que la demande soit présentée sous forme écrite (ex. : dans l’offre d’emploi ou par e-mail pendant le processus de recrutement) et qu’elle soit spécialement motivée par rapport aux besoins spécifiques du poste ;

La réduction du délai de conservation du bulletin de vingt-quatre mois à un mois à partir de la conclusion du contrat de travail ;

La destruction du bulletin si la personne concernée n’est pas engagée ;

La possibilité pour l’employeur de demander la délivrance d’un nouveau bulletin lorsque des dispositions spécifiques l’exigent (ex. : en matière de gardiennage, d’établissement financier) ou dans le cas d’une nouvelle affectation nécessitant un nouveau contrôle ;

Des sanctions pénales en cas de non-respect des nouvelles dispositions.
