On October 16, 2024, Birth Choice of San Marcos (“BirthChoice”) filed a notice of data breach with the Attorney General of California after discovering that a vendor used by BirthChoice, National Diagnostic Imaging (“NDI”), experienced a cyberattack. Evidently, on March 16, 2024, NDI experienced a data security incident affecting the company’s ability to access certain files on its network. In response, NDI secured its systems and then launched an investigation with the help of third-party cybersecurity experts.

Ultimately, this investigation confirmed that an unauthorized party was able to access BirthChoice’s network between February 19, 2024 and March 27, 2024. However, NDI did not notify BirthChoice until August 19, 2024.

NDI provided BirthChoice with the results of this review on October 15, 2024.
