DCCC Files Complaint Against FEC for Not Issuing an Advisory Opinion

The Democratic National Congressional Campaign Committee (DCCC) filed a complaint against the Federal Election Commission (FEC) last week claiming that the FEC is not enforcing contribution limits for coordinated expenditures between party and candidate committees under the parameters of joint fundraising regulations. While federal law limits contributions to candidates and coordinated spending by a party in support of their candidates, joint fundraising regulations allow candidates and other committees to coordinate for fundraising purposes. The DCCC alleges that joint fundraising committees are running coordinated political advertisements exceeding the limits by including a brief solicitation for a contribution at the end of the advertisement, and thus making it part of their fundraising efforts. Although the FEC had this matter before it through the advisory opinion process, they were not able to provide an opinion with the requisite number of votes, which the DCCC indicates is a violation of the Administrative Procedures Act.
