Delaware Bankruptcy Court Amends Local Rules

The Delaware Bankruptcy Court amended its local rules effective February 1, 2017.  A copy of the latest version of the rules may be found on the Bankruptcy Court's website. Click here to view.

The red-line version to the 2016 version shows the changes to the rules and may be found on the Court's website.  The most significant additions relate to local treatment of cross-border insolvency cases.   The rules add reference to Chapter 15 cases and Part X of the Local Rules adds "Guidelines for Communication and Cooperation Between Courts in Cross-Border Insolvency Matters."  The Guidelines are offered as a protocol in order to "improve in the interests of all stakeholders the efficiency and effectiveness of cross-border proceedings relating to insolvency or adjustment of debt opened in more than one jurisdiction ("Parallel Proceedings") by enhancing coordination and cooperation among courts under whose supervision such proceedings are being conducted."
