DHS Designation of Ukraine for TPS

In response to the ongoing attack on Ukraine, the U.S. Department of Homeland Security (DHS) announced today the designation of Ukraine for Temporary Protected Status (TPS) for 18 months, to take effect upon publication of an upcoming Federal Register notice.  TPS eligible Ukrainian nationals include those who have continuously resided in the United States since March 1, 2022.  TPS applicants must meet all eligibility requirements and undergo security and background checks.  Note: individuals who attempt to travel to the United States after March 1, 2022 will not be eligible for TPS.  In the coming days, it is expected DHS will publish a Federal Register notice providing instructions for applying for TPS and an Employment Authorization Document (EAD).  Fox Rothschild will post updates as they become available.
