On June 20, 2024, U.S. Citizenship and Immigration Services (USCIS) announced the extension of validity of Employment Authorization Documents (EADs or work permits) issued to Temporary Protected Status (TPS) beneficiaries from El Salvador, Honduras, Nepal, Nicaragua, and Sudan. The validity of these EADs will automatically extend to March 9, 2025. USCIS will send updated I-797 Notices of Action to individuals whose EADs would be extended. In practice, TPS beneficiaries must present their EAD cards and I-765 Extension (I-797 Form) to demonstrate their continuous ability to work in the U.S. for I-9 verification purposes.
USCIS encourages TPS beneficiaries from the above-referenced TPS designated countries to re-register for TPS under the most recent extension (if they have not already done so), during the current re-registration period to maintain their TPS benefits. They must submit Form I-821 during the registration period, which now run as follows:
