As we previously reported, the U.S. District Court for the District of Columbia ordered that the EEOC collect two years of EEO-1 Component 2 pay data by September 30, 2019. Per the court’s order, the EEOC’s data collection obligation would not be deemed complete until at least 72.7 percent of eligible filers submit the Component 2 EEO-1 data.
In a September 27, 2019 Status Report to the court, the EEOC reported that only 39.7 percent of eligible filers had completed submissions as of September 25, 2019. While noting that this low rate may be due to employers waiting until the September 30, 2019 deadline, the EEOC informed the court that the online portal would remain open as long as the court’s Order is in effect.
Because it is unclear how long the online portal will remain open, employers who missed the September 30 deadline should continue to work to file as soon as possible.
