On May 29, 2024, the Equal Employment Opportunity Commission (EEOC) announced that it filed suits against 15 employers for repeatedly failing to submit EEO-1 reports. According to the press release, these employers failed to file reports for reporting years 2021, 2022, and potentially additional years. The employers are from various industries including retail, construction, restaurant, manufacturing, logistics, and service. Lawsuits against employers by EEOC for failing to file EEO-1 reports are rare.
According to EEOC Chair Charlotte Burrows, private employers with 100 or more employees have been required to submit EEO-1 reports for nearly six decades to “…help the agency focus its resources, identify potential discrimination, and refine its investigations.” As part of this reporting, employers are required to submit workforce demographic data, including data by job category and sex and race or ethnicity.
