In Donelien v Liberata UK Limited the Court of Appeal confirmed that an employer is entitled to place "great weight" on occupational health's advice when assessing whether an employee is disabled.

All work and no pay – standby time at home was working time

In Ville de Nivelles v Matzak the CJEU found that standby time spent at home was working time, because the restrictions placed on the worker had a significant impact on his ability to pursue his own activities. But that did not automatically mean he was entitled to be paid for the on call time.
