Whether in connection with their marketing programs or other data-driven initiatives, nonprofit organizations are becoming more reliant on the data of their customers. Those that are collecting consumer data need to be aware of and in compliance with the latest laws regarding collection and protection. Whether due to compliance requirements or community expectations, it is of utmost importance that nonprofit organizations take steps to mitigate the risks associated with noncompliance. Discussion points will include:
- Laws regarding consumer data and privacy:
- California Consumer Privacy Act (CCPA)
- California’s Data Breach Notification Requirements
- California’s requirements concerning the protection of information collected by connected devices (SB 327)
- Criteria for determining if your company is subject to the CCPA, what constitutes personal information, and what the law requires (proactively and in connection with a data breach incident)
- Strategies for compliance and penalties/liability for failure to comply
- Potential for interaction with other laws (state, federal, and international)
- Insurance coverage for data breaches and privacy liability
