This time, the group leader did not respond and later testified that he had not read the messages. Instead, he reported the employee’s absences to the company’s human resources department. The employee’s employment then was terminated for job abandonment.
Procedural History
The employee filed a lawsuit, alleging FMLA retaliation, FMLA interference, and wrongful discharge under West Virginia law in violation of public policy (retaliatory discharge).
