On August 10, 2020, the Illinois Association of School Boards issued an important PRESS policy update. Although PRESS updates are often significant, this update, which addressed important issues ranging from supporting transgender students to pandemic preparedness, is particularly important. As always, your attorneys at Franczek P.C. have reviewed and recommend customizations to several of these policies and procedures. Specifically, we recommend important customizations to the policy addressing requirements under the recently-amended Student Online Personal Protection Act (SOPPA) (PRESS Policy 7:345). We recommend customizations to the PRESS grievance procedures based on recent amendments to the regulations implementing Title IX of the Education Amendments of 1972 (PRESS Policies 2:260 and 2:265). Note that Policy 2:265 should be posted on your website now as an administrative procedure, even if your Board has not yet approved it. For more information, read our Title IX Insights blog post on website posting requirements, related herein.

DISCLAIMER: Because of the generality of this update, the information provided herein may not be applicable in all situations and should not be acted upon without specific legal advice based on particular situations.
