The rise of generative artificial intelligence (AI) is presenting significant challenges to the legal community, particularly regarding the authenticity of digital evidence in an increasingly skeptical media environment. This skepticism is part of a growing phenomenon known as “deep doubt,” which questions the legitimacy of media artifacts due to the capabilities of generative AI. Rooted in the emergence of deepfakes in 2017, deep doubt has grown more pronounced with recent advancements in AI technology, directly influencing how courts and legal professionals approach digital evidence.

Legal scholars Danielle K. Citron and Robert Chesney coined the term “liar’s dividend” to describe how deepfakes can be weaponized to discredit authentic evidence. This trend has far-reaching implications for political discourse, legal systems, and the collective understanding of historical events. As deep-learning technology advances, creating false or modified media that appears genuine becomes easier, further eroding trust in digital media and challenging courts’ ability to authenticate evidence.

Recent examples of deep doubt include conspiracy theories about President Joe Biden being replaced by an AI hologram and former President Donald Trump’s baseless accusations that Vice President Kamala Harris used AI to fake crowd sizes at her rallies. These high-profile instances illustrate how deepfakes can sow doubt, even when clear evidence is presented, raising concerns about how courts can maintain trust in digital media. The legal ramifications came into sharp focus during a meeting of the US Judicial Conference’s Advisory Committee on Evidence Rules. Federal judges highlighted the potential for AI-generated deepfakes to cast doubt on genuine evidence in court trials. The rise of these technologies means courts must now reconsider traditional methods of evidence authentication to address the complexities of AI manipulation.

Courts are grappling with the growing challenges posed by AI-generated content, particularly in cases where deepfakes could undermine the authenticity of evidence. As the judiciary confronts increasingly sophisticated AI manipulations, traditional methods like Rule 901, which sets a low bar for authenticating evidence, are being tested. Judges must now consider how to manage AI-generated material in high-stakes trials, including national security and intellectual property disputes. Additionally, AI-generated content can spread disinformation and influence public opinion, further exacerbating media skepticism and complicating the discovery and authentication processes in legal cases.

Beyond intellectual property and cybersecurity, AI poses a significant risk to national security. Research from Gryphon Scientific and the Rand Corporation reveals the potential misuse of AI for creating biological weapons. Their findings indicate that advanced AI models could provide malicious actors with detailed information to execute biological attacks, raising serious concerns about national security and public safety. The ability of AI to generate high-level, detailed information that can be weaponized underscores the broader threat to legal proceedings, where AI-generated data might be used as evidence. Courts will need to develop new approaches to managing these complex cases, ensuring that AI-generated materials do not compromise the fairness or outcomes of trials.

The political landscape is also being reshaped by the proliferation of AI-generated content. During the 2024 presidential campaign, both parties utilized AI to create memes and videos that, while often absurd, can propagate false and sometimes racist narratives. For instance, former President Trump’s campaign repeatedly promoted AI-generated memes falsely accusing Haitian migrants of stealing and eating pets in Springfield, Ohio. Francesca Tripodi, an expert in online propaganda, notes that these AI-created images are new vehicles for spreading age-old anti-immigration sentiments. Globally, AI-generated deepfakes have influenced elections, from Slovakia to New Hampshire. These tools make it easier to produce hyper realistic political content quickly, amplifying disinformation. As such, courts must be prepared to address cases involving AI-driven political attacks, where the authenticity of evidence will likely be a focal point in litigation.

While generative AI offers numerous benefits, its potential for misuse presents legal, political, and security challenges that require urgent attention. The legal community, in particular, must navigate these complexities to uphold the integrity of digital evidence in the courtroom.

Despite these challenges, there is an ongoing effort to regulate and mitigate the risks associated with AI-generated content. Major social media platforms like Facebook, Twitter, and YouTube have implemented policies to identify and remove deepfakes, though the effectiveness of these measures varies. Legal experts and national security advisors, such as White House National Security Adviser Jake Sullivan, acknowledge the complexity of the issue. Sullivan notes that the power of AI, combined with the intent of state and non-state actors to manipulate information, poses a significant threat to democracies and requires vigilance. Courts, legal professionals, and cybersecurity experts must collaborate to address these risks, ensuring that deepfakes and AI-generated content do not undermine the integrity of legal proceedings or the reliability of evidence.

While generative AI offers numerous benefits, its potential for misuse presents legal, political, and security challenges that require urgent attention. The legal community, in particular, must navigate these complexities to uphold the integrity of digital evidence in the courtroom.
