  • A bipartisan coalition of 17 AGs and the U.S. DOJ obtained a favorable ruling in the U.S. District Court for the Eastern District of Virginia in their antitrust case against Google LLC.
  • As previously reported, the suit alleged that Google engaged in a systematic campaign to control the digital advertising technology sector through anticompetitive and monopolistic conduct in violation of the Sherman Act.
  • In its opinion, the court held that Google unlawfully maintained monopolies in the markets for publisher ad servers and ad exchanges used for open-web display advertising. However, the court ruled in Google’s favor on the government’s claims related to advertiser ad networks, finding the market definition insufficient because it failed to account for networks supporting alternative advertising channels.
  • The court will address remedies in a future proceeding.
