The Alabama Department of Environmental Management (“ADEM”) and George C. Marshall Space Flight Center (“MSFC”) entered into a July 10th Consent Order (“CO”) addressing an alleged violation of the Alabama Hazardous Waste Regulations. See Consent Order No. 24-XXX-CHW.

The United States National Aeronautics and Space Administration (“NASA”) is stated to operate the MSFC.

MSFC is described as a research and development facility located in Madison County, Alabama.

The facility has been assigned a United States Environmental Protection Agency ID.

MSFC is stated to have notified ADEM on December 11, 2023 of an action that took place on that date. On that date, MSFC is stated to have discovered that six roll-off boxes exceeded the 90-day accumulation limit on December 6, 2023. The subsequent incident report is stated to have indicated the following violation.

The alleged violation is described as involving ADEM Administrative Code R.335-14-3-.01(7)(a) which provides in part that:

…a large quantity generator may accumulate hazardous waste on site without a permit or interim status provided the generator accumulates hazardous waste on site for no more than 90 days.

MSFC is stated to have accumulated hazardous waste on site for more than 90 days.

MSFC neither admits nor denies ADEM’s conventions.

A civil penalty of $8,800.00 is assessed.
