Hazardous Waste Enforcement: Louisiana Department of Environmental Quality and Hammond Hazardous Waste Storage Facility Enter into Settlement Agreement

The Louisiana Department of Environmental Quality (“LDEQ”) and LEI, Inc. (“LEI”) entered into a Settlement Agreement (“SA”) addressed alleged violations of certain hazardous waste regulations. See SA-HE-23-0086.

The SA provides that LEI owns and/or operates a permitted hazardous waste storage and universal waste designation facility in Hammond, Louisiana.

LDEQ is stated to have conducted inspections on March 8, 2021, and March 19, 2021, of the facility. The stated purpose of the inspections was to determine the degree of compliance with the Louisiana Environmental Quality Act, the hazardous waste regulations, and the Hazardous Waste Operating Permit.

The SA states that the following violations were identified:

  • Failure to clean up in a timely manner any spilled material or material trapped in sumps that is a hazardous waste or that will be disposed of as hazardous waste.
  • Failure to maintain and operate all facilities to minimize the possibility of a sudden or non-sudden release of hazardous waste or hazardous constituents to air, soil, or water that could threaten human health or the environment.
  • Failure to maintain a constant negative air pressure in the lamp process facility and hazardous waste storage area.

LEI denies it committed any violations or that it is liable for any fines, forfeitures and/or penalties.

The SA assesses a civil penalty of $3,000.
