  • Illinois AG Kwame Raoul settled with TBJ Drywall & Taping, Inc. (TBJ), resolving allegations that the company misclassified employees and failed to pay overtime wages in violation of state labor and employment laws.
  • The complaint alleges that TBJ misclassified some employees as independent contractors, failed to pay misclassified employees for overtime worked, and paid other employees for overtime work performed on the weekends “off the books” in cash and at a rate lower than the required overtime rate.
  • Under the terms of the settlement, TBJ must pay $718,000 in into a settlement account for claimants, among other relief.
  • We have reported on other state AG enforcement actions regarding similar wage theft and misclassification claims, including a lawsuit filed by New Jersey AG Matthew Platkin and a settlement that C. AG Brian Schwalb reached.
