The Illinois Service Member Employment and Reemployment Rights Act (ISERRA) takes effect January 1, 2019. This law replaces the Illinois Military Leave of Absence Act and expands job-related protections afforded to Illinois service members.

Specifically, ISERRA affords employees who are service members protections related to discrimination and leaves of absence. Among other requirements, Illinois employers must display a Notice of Rights and Benefits, a copy of which is available here

Because ISERRA creates a private right of action to individual employee claimants as well as regulatory enforcement authority by the Illinois attorney general, employers need to be mindful of their compliance with ISERRA.
