EU–DGCOMP is encouraging merging parties to delay notifications and discuss timing of transactions with the relevant case teams, as DGCOMP is facing difficulties in collecting information from the parties and the market (e.g., customers, competitors and suppliers). Requests for information that stop the clock or instances of “pull and refile” cannot be excluded. However, DGCOMP will review cases in which parties can show very compelling reasons to proceed with a merger notification without delay (DGCOMP has been accepting simplified filings in the last days).
