Judge Timothy Kelly, a Trump nominee, to hear lawsuit to determine CFPB Acting Director; TRO hearing scheduled for 4:30 today

The declaratory judgment action and motion for temporary restraining order filed by Leandra English in the D.C. federal district court for a declaration that she, and not Mick Mulvaney, is the CFPB Acting Director has been assigned to Judge Timothy Kelly.  A hearing on the TRO motion has been scheduled for 4:30 p.m. today.

Judge Kelly, who is approximately 48 years old, was nominated by President Trump and confirmed by the Senate by a 94-2 vote in September 2017.  After spending several years in private practice, Judge Kelly served as an Assistant U.S. Attorney in the District of Columbia for four years and thereafter as a trial attorney in the Public Integrity Section of the Department of Justice’s Criminal Division for six years.  Following his tenure with the DOJ, Judge Kelly served in several Congressional staff positions, including counsel to the Senate Judiciary Committee’s ranking member from 2013 to 2014 and Chief Counsel for National Security and Senior Crime Counsel to the Chair of the Senate Judiciary Committee from 2015 to 2017.
