Up to Speed: No variation clauses now worth the paper they're written on A&O’s new “Up to Speed” article focuses on variation clauses. Variation clauses are often referred to as no oral modification or NOM clauses and are commonly found in the “boilerplate” of commercial contracts. They
stipulate that no variation to a contract shall be binding unless it is in writing and signed by both parties and may include other specifications that variations to the contract must meet in order to be binding.
