Malawi Makes Several Important Declarations Regarding To Joining The Madrid Protocol

On September 25th, 2018, Malawi became the 102nd member of the Madrid Protocol, which will enter into force on December 25th, 2018. As part of joining the Madrid Protocol, Malawi declared the following as part of the instrument of accession:

  • An 18-month refusal period in order to notify opposition based refusals after the expiration date;
  • The requirement of a declaration of intent to use a trademark when Malawi is listed in an international application or a later designation is noted in the Madrid Agreement and Protocol;
  • Recording licenses with the International Register will not be viable in Malawi under the Madrid System.  However, a license associated with an international registration will be registered in the Register of the Office of Malawi.
