According to a recent report by WebRecon, court filings under the Fair Debt Collection Practices Act (FDCPA) and Fair Credit Reporting Act (FCRA) were down for the month of March while court filings under the Telephone Consumer Protection Act (TCPA) and complaints filed with the Consumer Financial Protection Bureau (CFPB) were up. Year-to-date everything is still up by double digits compared to 2023, including a notable 60.4% increase in CFPB complaints.
WebRecon reports the overall statistics for consumer litigation in March as follows:
- 469 FCRA cases were filed, representing a 30.6% decrease from February;
- 319 FDCPA cases were filed, representing a 13.1% decrease from February;
- 139 TCPA cases filed, representing a 1.5% increase from February; and
- 12,335 complaints filed with the CFPB, representing a 39.0% increase from February.
Although this month was a mixed bag, filings were still up in all categories compared to January 1 to April 1, 2023 (FDCPA +12.9%, TCPA +26.6%, FCRA +28.4%, CFPB +60.4%).
