Maryland recently decided to increase the pay disclosure requirements applicable to employers posting positions for work performed in Maryland. Maryland employers must now disclose the wage range, salary, benefits, and any other compensation for internally and externally posted positions beginning on October 1, 2024.
Maryland had previously required employers to provide salary and compensation information in the form of a wage range to an applicant only if that applicant requested such information. Before adoption of this new law, there was no affirmative posting requirement applicable to employers in Maryland.
Beginning on October 1, 2024, Maryland employers must now disclose a position’s wage range or salary, benefits, and any other compensation information at the time the position is posted. The wage range refers to the minimum and maximum pay for a position or the budgeted amount for the position. The requirements apply to both internal and external postings. In addition, Maryland employers must disclose the required information to an applicant before discussing compensation, if the applicant was unable to access the posting. The new requirement applies to all positions, including remote work, where any part of the job duties are performed in Maryland. Employers considering virtual applicants who might work from Maryland should ensure compliance.
Maryland joins a long list of other states requiring affirmative posting of wage range, salary, benefits, and other compensation. Employers with employees or prospective employees in Maryland should update their posting requirements to comply with this new law before October 1, 2024.
