The Senate of the Republic approved the initiative to reform the Federal Labor Law that establishes the first day of October of every six years as a mandatory day of rest, on the occasion of the transfer of the Federal Executive Power.
The initiative presented by Senator Napoleón Gómez Urrutia, of the Morena Parliamentary Group, amends Article 74 of the Federal Labor Law to harmonize the provisions of the Federal Labor Law with the constitutional decree promulgated on February 10, 2014, which establishes the reform of the transition period between the presidential elections and the swearing-in of the Head of the Federal Executive.
According to the decree published on February 10, 2014, the President of the Republic will take office on October 1, instead of December 1. Despite the fact that the constitutional reform was proposed in 2014, Claudia Sheinbaum is the first president to take the presidential oath on October 1.
The amendment approved by the Senate of the Republic would be as follows:
- Article 74. The following are mandatory rest days:
I. to VI. ...
VIl. On October 1 of every six years, when it corresponds to the transfer of the Federal Executive Power;
VIII. and IX ....
In this way, workers will enjoy a mandatory day of rest on October 1 instead of December 1, as previously stipulated. With the above, it is established that workers who work on October 1 will be entitled to receive a triple payment for the day worked.
Likewise, if workers do not receive triple payment for working on October 1, the Federal Labor Law contemplates fines ranging from 5,187 to 518,700 pesos.
