Changes regarding cannabis law in Minnesota are underway as HF3595 passed as part of an amendment to HF4065 in both the House and Senate and the bill was signed by Governor Tim Walz (D) on June 2, 2022. HF3595 sets out to implement a series of regulations for products containing cannabinoids in the state of Minnesota that would go into effect starting August 1, 2022.

The bill permits the sale and consumption of nonintoxicating cannabinoids in forms such as (i) food, beverages, topicals, etc. so long as they do not contain more than 0.3 percent of any tetrahydrocannabinol (THC) and (ii) edible cannabinoid products that contain no more than 5 mg of any THC per serving and 50 mg of any THC per package, in each case, regardless of whether that THC is delta-8 or delta-9.

HF3595 contains a series of supplementary regulations regarding the testing, packaging, and labeling of products containing edible cannabinoid products to ensure the safety, transparency, and proper serving sizes regarding the products to consumers. Several provisions were included namely to prevent and deter children’s usage of these cannabinoid products. The bill also places an age restriction as buyers of these products must be at least 21 years of age.

While adult-use marijuana legalization failed this session, the Minnesota legislature has paved the way for expanding the local cannabis market.
