The National Advertising Division (NAD) issues decisions on a periodic basis involving advertising claims submitted to it for review. Although the full case decisions are not publicly available without a subscription, the Better Business Bureau (BBB) does publish NAD case summaries on its website that are helpful in understanding how the NAD thinks about certain types of advertising claims. In fact, BBB National Programs provides summaries of all case decisions from the National Advertising Division (NAD), National Advertising Review Board (NARB), Children’s Advertising Review Unit (CARU), Direct Selling Self-Regulatory Council (DSSRC), and Digital Advertising Accountability Program (DAAP) and also provides full case decisions from the DSSRC and DAAP.

According to NAD’s website, NAD “holds national advertising across all media types to high standards of truth and accuracy by reviewing truth-in-advertising challenges from businesses, trade associations, consumers, or on its own initiative” and “through its work, thousands of misleading advertising claims have been removed from the marketplace and NAD’s case decisions represent the single largest body of advertising law in the country.” Again, summaries of these case decisions are publicly available and can be consulted to further understand what the NAD views as improper advertising in the marketplace.

Additional information regarding NAD’s advertising challenge options can be found in prior blog posts here and here.
