New York AG Teams with Federal Government on Toluene Emissions Settlement

  • New York AG Letitia James, together with the EPA and the DOJ, reached a settlement with FrieslandCampina Ingredients North America, Inc. to resolve allegations that its Delhi, New York facility emitted dangerous air and water pollution in violation of state and federal environmental laws.
  • According to the Government, Friesland’s batch manufacturing process results in the emission of a volatile organic compound called toluene. The complaint alleged that Friesland violated the Clean Air Act and state laws by failing to obtain appropriate permitting for its toluene emissions and by failing to install necessary technologies to limit the emissions, among other things.
  • Under the terms of the settlement, Friesland will pay a $2.88 million civil penalty, which will be evenly split between the U.S. government and the state of New York. In addition, Friesland agrees to comply with applicable environmental laws and permitting requirements, and to implement a Supplemental Environmental Project to prevent future pollution.
