Now that the 2018 midterm elections are firmly in the rearview mirror, here are your public-law highlights:

  • Post-election coverage. The Colorado Sun has these great round ups on Colorado’s election results. It turned out to be a Democratic sweep, with all statewide offices and both houses of the General Assembly going blue. Nationally, the Democrats took the House but the Republicans gained ground in the Senate.
  • Grove appointed to the Court of Appeals. The Governor appointed Assistant Solicitor General Matt Grove to the Colorado Court of Appeals. Grove is the 183rd judicial appointment Hickenlooper has made. He’ll take the spot of retiring Chief Judge Alan Loeb.
  • Jury rejects RICO claim against marijuana grow. In a lawsuit with major implications for the marijuana industry, a Colorado jury determined that a grow facility did not lower neighboring property values. The plaintiffs brought the case under a federal anti-racketeering law originally passed to combat organized crime.
  • Newspaper takes open records case to SCOTUS. The Colorado Independent filed a cert petition before the US Supreme Court, asking the Justices to review a state supreme court decision denying access to sealed records in a criminal case. A decision on the petition isn’t expected for several weeks.
