The following legislation was signed by New Jersey Governor Phil Murphy on March 19, 2020:
- A-3860 authorizes the use of telemedicine by both New Jersey licensed practitioners and those from out-of-state, in accordance with the standard of care regardless of whether rules and regulations had been promulgated by the various licensing boards. Unless a physician has a preexisting provider-patient relationship, the legislation limits telemedicine services to services related to screening for, diagnosing, or treating COVID-19. The tacit reciprocity of licensure under the legislation is for the duration of the state public health emergency declared on March 9, 2020.
- A-3843 requires health insurance carriers, employee health benefit programs, and Medicaid to provide coverage for expenses relating to tests for COVID-19 and delivery of telehealth and telemedicine services in accordance with NJSA 45:1-61, et seq. There will be no cost-sharing imposed for these services. The bill will remain in effect during the pendency of the state public health emergency.
