Pennsylvania Office of Open Records Updates RTKL Fee Schedule

Section 1307 of the Right-to-Know Law (“RTKL”) requires that the Office of Open Records (“OOR”) establish a fee schedule for Commonwealth agencies and local agencies that establishes the fees for duplication by photocopying, printing from electronic media or microfilm, copying onto electronic media, transmission by facsimile or other electronic means and other means of duplication that agencies can charge when responding to RTKL requests.

On October 15, 2018, the OOR adopted a revised fee schedules that makes the following changes:

  1. The fee for color copies is now “up to $0.50 per copy.”
  2. The definition of “copy” now includes both 8.5×11 and 8.5×14 paper.
  3. Under “Additional Notes,” a new paragraph entitled “Medium Requested” states that “a record being provided to a requester shall be provided in the medium requested if it exists in that medium; otherwise, it shall be provided in the medium in which it exists. This is simply a restatement of Section 701 of the RTKL.

Agencies should review their current fee schedule and confirm that it is consistent with the OOR’s revised fee schedule, which is available online at: https://www.openrecords.pa.gov/RTKL/FeeStructure.cfm
