Pennsylvania Strengthens Consumer Protections for Car Buyers

  • Pennsylvania AG Michelle Henry has announced an amendment to the Pennsylvania Automotive Industry Trade Practices regulations to improve transparency for consumers in automobile advertising and sales.
  • The amendment, which took effect on August 19, 2024, broadens the definition of “advertisement” to explicitly include online statements and representations. It also mandates that motor vehicle dealers inspect each vehicle within 30 days of adding it to their inventory for certain unsafe conditions. Additionally, vehicles accumulating 500 or more miles on the dealer’s lot must undergo another safety inspection. Dealers are required to disclose in writing any unsafe conditions—such as flood damage or a bent frame—before a sale, even if the vehicle is sold “As Is.”
  • Certain motor vehicle transactions are exempt from the amendment, including sales between licensed dealers, through authorized vehicle auctions, sales of salvaged or nonrepairable vehicles with the appropriate certificate, or if the vehicle is advertised or offered for sale while located outside of Pennsylvania.
