The Michigan Attorney General (“AG”) filed a Complaint in the Michigan Circuit Court for the 30th Judicial Circuit against Ox Paperboard WP, LLC (“Ox”) and White Pigeon Mills, LLC (“White Pigeon”) for alleged violations of a wastewater permit. See No. 24-880-CZ.
Ox and White Pigeon are stated to be the current operator and owner, respectively, of a paper board mill in White Pigeon, Michigan.
The Complaint seeks injunctive and declaratory relief to protect the waters of the State of Michigan by requiring Ox to:
- Properly close the wastewater lagoons at the Site;
- Cease its unpermitted and unauthorized discharges to the waters of the state at the Site; and,
- Pay civil fines to resolve its violations of Part 31, Water Resources Protection, of the Natural Resources and Environmental Protection Act (NREPA), MCL 324.3101 et seq. (Part 31), the Part 21, Wastewater Discharge Permits, administrative rules promulgated pursuant to Part 31, Mich Admin Code, R 323.2101 et seq. (Part 21 Rules), and the Part 22, Groundwater Quality, administrative rules promulgated pursuant to Part 31, Mich Admin Code, 2 R 323.2201 et seq. (Part 22 Rules) at the Site. The State also seeks additional relief described below.
The Complaint alleges that the mill has undergone unauthorized and unpermitted discharges into waters of the state, which include the Pigeon River and groundwater.
The AG’s Complaint contends that certain unauthorized wastewater discharges have resulted in the release of PFAS.
