President’s Vaccination Mandate For Federal Contractor’s Put On Hold

Yesterday, a Southern District Court in Georgia issued a nationwide stay of the Biden administration’s vaccination mandate for employees of federal contractors. The court concluded that the plaintiffs likely will succeed in their claim that the President exceeded the authorization given to him by Congress through the Federal Property and Administrative Services Act
when issuing the executive order.

This order will likely be appealed. However, it remains to be seen how quickly the issue will be resolved. Similar stays on the President’s other vaccination mandates for employers of over 100 employees and healthcare facilities are also subject to similar stays and have yet to be resolved.

While this order gives federal contractors some breathing room, it also adds uncertainty into the mix as to when the order will be implemented. We will continue to keep employers updated with any developments.
