Process to Promote the Unity and Stability of Families (Parole in Place)

President Biden announced a new program for individuals who are in the United States without inspection. Under this new program, individuals will be able to request Parole in Place from USCIS. To be eligible, individuals must show the following:

  • Are in the United States without admission or parole.
  • Have been continuously present in the United States for at least 10 years as of June 17, 2024.
  • Be legally married to a U.S. citizen as of June 17, 2024.

In addition, individuals must not have disqualifying criminal history or otherwise constitute a threat to national security or public safety.

If granted, the individual will receive Parole in Place for up to three years. During this period, the individual will be eligible to apply for permanent residence without having to leave the country. They will be allowed to remain with their families in the United States and will be eligible for work authorization for up to three years.

USCIS is not accepting applications at this time. Applications for this program will be accepted beginning on Aug. 19.

Although USCIS is not currently accepting applications, individuals can prepare by collecting the following evidence:

  • Evidence they have continuously lived in the United States for at least 10 years, as of June 17, 2024.
  • Evidence they were married to a U.S. Citizen as of June 17, 2024.
  • Documentation of proof of identity.
  • Evidence they do not have any disqualifying criminal history.
