Plaintiff Daniela Gruen recently filed a class action complaint in the United States District Court for the Northern District of California against The Clorox Company and The Burt’s Bees Products Company claiming that some Burt’s Bees Cosmetic Products, including mascaras and lip gloss, contain PFAS based on testing performed by EWG. Plaintiff is seeking monetary compensation through several causes of action—breaches of express and implied warranties, fraudulent concealment, unjust enrichment, and other claims under California and New Jersey consumer fraud statutes—on the theory that, had the companies disclosed the alleged presence of PFAS, her proposed class of consumers either would not have purchased the products at issue or would not have paid a premium for products marketed as “natural.” We’re sure that the parties will be busy as bees, and we’ll keep our loyal readers informed of any new developments in this or other similar cases.
