  • A group of 24 Republican AGs and Arizona legislative leaders have filed a motion to stay the EPA’s final rule on Standards of Performance for New, Reconstructed, and Modified Sources and Emissions Guidelines for Existing Sources: Oil and Natural Gas Sector Climate Review.
  • In the motion to stay, the movants argue that the court should stay the final rule—which regulates greenhouse gases and volatile organic compounds (such as methane) emitted by the crude oil and natural gas sector—because the final rule is contrary to the Clean Air Act’s framework of cooperative-federalism and is arbitrary and capricious, and they further argue that states will suffer irreparable economic harm and injuries to their sovereign interests.
  • The AGs and Arizona legislative leaders seek a stay of the final rule and an administrative stay of the rule while the motion is pending.
