Juries in Philadelphia and San Diego recently awarded damages of $175 million and $332 million to two men who were diagnosed with non-Hodgkin lymphoma after being exposed to the weedkiller Roundup.

The two verdicts are Bayer and Monsanto’s second and third legal defeats over the last month in Roundup litigation. Bayer has set aside roughly $16 billion to handled the cost of future Roundup lawsuits that are filed against the company.

In the wake of these two verdicts, individuals who were exposed to Roundup, were diagnosed with non-Hodgkin lymphoma, and are still living may also qualify to file a lawsuit and receive compensation for their illness.

Philadelphia Jury Awards $175 Million to Roundup User With Lymphoma

In Philadelphia, a jury recently awarded $175 million in damages to a retired restaurant owner who was diagnosed with non-Hodgkin lymphoma after years of being exposed to the weedkiller Roundup.

In his lawsuit against Monsanto, Ernest Caranci and his wife alleged that Mr. Caranci developed lymphoma after 20 years of being exposed to glyphosate, the herbicide in Roundup. They alleged that Monsanto and Bayer AG, the company that purchased Monsanto in 2018, failed to properly warn consumers about the carcinogenic effects of exposure to glyphosate.

A jury for the Philadelphia County Court of Common Pleas agreed with Mr. Caranci’s allegations. The jury awarded Mr. Caranci and his wife $25 million in compensatory damages, plus an additional $150 million in punitive damages against Monsanto and Bayer.

The next Philadelphia Roundup lawsuit against Bayer and Monsanto is scheduled to go to trial on November 6, 2023.

Roundup User With Lymphoma Awarded $332 Million in San Diego

In San Diego, a jury awarded $332 in combined damages to 57 year old Mike Dennis, a former land surveyor who alleged that he developed non-Hodgkin lymphoma after years of being exposed to Roundup in gardens and lawns.

The jury awarded Mr. Dennis a total of $2 million in post-noneconomic damages, $5 million in future noneconomic damages, and $325 million in punitive damages against Bayer.

As in the Philadelphia lawsuit, Mr. Dennis alleged that Bayer and Monsanto failed to properly warn consumers about the risk of developing lymphoma or other cancers that they faced from using Roundup or other glyphosate herbicides.

Legal Pressure on Bayer Mounts Following Studies, Denial of Regulatory Approval

Bayer and Monsanto have faced increased legal pressure in recent months over the link between Roundup and lymphoma following research that linked the herbicide to an increased cancer risk, as well as decisions by regulatory not to extend approval for the weedkiller.

In a May 2023 study, the National Cancer Institute reported that farmers who had been exposed to glyphosate showed increased levels of oxidative stress, an important biomarker that indicated an increased risk of later developing cancer. The authors of the study called for additional research into the link between Roundup and other glyphosate herbicides and an increased risk of cancers such as non-Hodgkin lymphoma.

In October 2023, health regulators with the European Union failed to grant a 10-year extension on the approval for the use of glyphosate in Europe, citing concerns about the risk of cancers such as lymphoma associated with the herbicide. At least six countries who were involved in the vote have gone on record to state that they believe that the use of glyphosate should be banned in Europe.

Roundup Users With Lymphoma May Qualify to File a Lawsuit

Although Bayer paid $10.9 billion in 2020 to settle the majority of the Roundup cancer lawsuits that had been filed against the company, more than 40,000 lawsuits filed on behalf of Roundup users with non-Hodgkin lymphoma or other types of cancer are still pending. The company has set aside $16 billion to handle the costs associated with resolving these ongoing Roundup and glyphosate lawsuits.

Consumers who used Roundup or were exposed to glyphosate, were diagnosed with non-Hodgkin lymphoma, and are still living may still qualify to file a lawsuit against Bayer and Monsanto and receive compensation for their illness.
