Stormwater Enforcement: Mississippi Commission on Environmental Quality and Gulfport Vacant Land Project Operator Enter into Agreed Order

The Mississippi Commission on Environmental Quality (“MCEQ”) and Gene Stock Construction (“GSC”) are stated to have entered into an April 6th Agreed Order (“AO”) relating to a failure to obtain a permit for discharge of waste into the water of the state. See Order No. 7106 21.

The AO provides that GSC has a “Vacant Land Project” (“VLP”) in Gulfport, Mississippi.

GSC is stated to have failed to obtain coverage under Mississippi’s Large Construction Storm Water General Permit before its commencement of construction activities at the site.

The AO provides that on November 30, 2020, MCEQ’s Environmental Permits Division received a Large Construction Notice of Intent for coverage under the Large Construction General Permit from GSC for the VLP. The Notice of Intent is stated to be under review.

The AO assesses a civil penalty of $7,350.
