Stormwater Enforcement: U.S. Environmental Protection Agency and Walpole, Massachusetts Development Enter into Expedited Settlement Agreement

The United States Environmental Protection Agency (“EPA”) and Wall Street Development Corporation (“Wall Street”) entered into a November 27th Expedited Settlement Agreement (“ESA”) to address alleged violations of certain Clean Water Act permitting provisions. (“Permit”). See CWA-01-2019-0040.

The ESA provides that Wall Street discharged stormwater from Boyden Estates development in Walpole, Massachusetts without authorization by a permit issued pursuant to the Clean Water Act.

A discharge without authorization by a Clean Water Act Permit is stated to be a violation of Section 301(a) of the statute.

The ESA includes an Expedited Settlement Offer Worksheet which details the alleged findings and alleged violations. A penalty amount is identified for each alleged violation.

A civil penalty of $7,020 is assessed by the ESA.
