Stark, C.J.  Defendant’s motions for summary judgment of non-infringement and invalidity are denied.

The patent-in-suit relates to system for capturing image data along with positional information and processing to allow a user to navigate through the image data.  The court finds that these motions present largely a battle of the experts not amenable to resolution through dispositive motions. With respect to non-infringement, the experts dispute the interpretation of the camera path limitation. As for invalidity, the experts disagree whether a particular system properly qualifies as prior art.  Genuine issues of material fact preclude a finding of obviousness before trial.
