On May 26, 2022, the United States Supreme Court ruled to allow the Biden Administration to continue using the social cost of carbon estimates in its regulatory analyses, developed pursuant to President Biden’s Executive Order 13990 (“EO 13990”). Ten states had won an injunction barring the Administration’s use of the social cost of carbon from a Louisiana district court, which the Fifth Circuit then stayed. The Court’s order leaves the stay in place while the government appeals the district court’s decision.
