We previously reported on the case between Teladoc, Inc. and the Texas Medical Board (Board) (related post here). The medical board issued regulations requiring doctors to see patients in person before prescribing medication. Teladoc sued the board over the regulations and the board moved to dismiss the lawsuit.

Judge Robert Pitman recently denied the board’s Motion to Dismiss so the case will proceed.
