As the deadline for compliance approaches, all NYC employers are reminded of their obligation to prominently display, and distribute to employees, the “Workers’ Bill of Rights” poster, as mandated by a city law enacted in late 2023. Effective July 1, 2024, every NYC employer must display the “Your Rights at Work ” poster in an accessible and visible location for employees and distribute it. There is no formal guidance on the required method of distribution and, as such, we see no reason why email distribution would be inadequate. If employers use intranet or mobile apps regularly for employee communication, they must also post it there. Employers are also required to provide a copy of the poster on or before a new employee’s first day of work.

The Workers’ Bill of Rights itself was published by the New York City Department of Consumer and Worker Protection (DCWP) on March 1, 2024. The publication serves as a guide outlining certain workplace rights enforced by DCWP, such as paid safe and sick leave; temporary changes in work schedule; commuter benefits; and fair workweek schedules, etc. It also details, among other things, various other rights under federal, state, and local law, and provides guidance on how employees can file complaints.

With respect to enforcement, penalties may include a warning for initial non-compliance and escalate to a $500 civil penalty for subsequent violations. Employers are advised to ensure full compliance to avoid penalties.
