On April 1, 2009, the U.S. Supreme Court in 14 Penn Plaza L.L.C. v. Pyett, held that a provision in a collective bargaining agreement that clearly and unmistakably requires union members to arbitrate federal age discrimination claims is enforceable as a matter of law.
