Today, the Supreme Court of the United States granted certiorari in one case:
Hain Celestial Group v. Palmquist, No. 24-724: This case addresses the scope of federal courts’ diversity jurisdiction. In the underlying case, the defendant removed to federal court on the basis of diversity jurisdiction, asking the district court to dismiss a non-diverse defendant as fraudulently joined. The district court did so, and the case proceeded through trial. After trial, the Fifth Circuit held the dismissal of the non-diverse defendant was improper and vacated the judgment in full, concluding the court lacked jurisdiction to hear the case. The question presented is: Whether a district court’s final judgment as to completely diverse parties must be vacated when an appellate court later determines that it erred by dismissing a non-diverse party at the time of removal.
