On December 31, 2020, the Trump Administration extended the proclamations suspending entry of foreign nationals outside the United States seeking certain nonimmigrant (temporary) work visas and immigrant visas (green cards) until March 31, 2021. See our previous news alerts on the nonimmigrant proclamation here and immigrant proclamation here.

In short:

  • The nonimmigrant proclamation continues to ban the U.S. entry of new H-1B, H-2B, L-1A/L-1B, and certain J-1 classifications, including derivative spouses and children. Limited exceptions may apply.
  • The immigrant proclamation continues to ban the entry of foreign nationals applying for permanent residence (a green card) outside the United States through a U.S. Consulate/Embassy. Limited exceptions may apply.

It is likely these policies will be evaluated, and perhaps rescinded, early in the Biden presidency.
