Federal Investigation Found School District Failed to Promote a Hispanic Vice Principal

FRESNO, Calif. – The Tulare City School District settled a federal charge of national origin discrimination filed with the U.S. Equal Employment Opportunity Commission (EEOC) for $45,000 and other injunctive relief, the federal agency announced today.

According to the EEOC, the Tulare City School District failed to promote an employee to the position of principal because of his Hispanic national origin, regardless of his qualifications and ability to do the job.

The EEOC investigated the allegations and found reasonable cause to believe the Tulare City School District had violated Title VII of the Civil Rights Act of 1964.

Without admitting liability, the Tulare City School District entered into a conciliation agreement with the EEOC. The school district agreed to pay $45,000 to the discrimination victim and provide training to supervisors and managers on Title VII. Additionally, the school district will post a notice to all employees about the resolution of this charge and their rights under federal anti-discrimination law. The EEOC will monitor compliance with this agreement.

“It is imperative that employers put in place objective measures during the hiring process in order to prevent subjective and unintentional biases that may negatively impact the selection process,” said Armando Hernandez, director of the EEOC’s Fresno local office. “We commend the Tulare City School District for resolving this charge, recognizing areas for improvement, and putting in place training measures that will benefit employees throughout the school district.”
